The Works
The Tenant was served with a Schedule of Dilapidations when they attempted to exercise their Break Clause.
The Tenant had the benefit of a Schedule of Condition to restrict their repairing liability under the terms of the Lease.
Our Involvement
We acted on behalf of the tenant, inspecting the property, assessing the liabilities under the Lease and taking account of the Schedule of Condition.
We co-ordinated third party Legal and Section 18 Valuation advice to formulate a response to the schedule.
Outcome
Following investigations, we assessed the likely loss much lower than the Landlord’s claim.
Following negotiations, we proved the Landlord had not, and was not intending; to incur a loss and the claim was rejected.
